Be qualified as a child of the
1. A child born to parents who are married to each other (born in wedlock);
2. A stepchild if the marriage creating the step-relationship took place before the child reached the age of 18;
3. A child born out of wedlock (the parents were not married at the time the child was born);
4. An adopted child if the child was adopted before the age of 16 and has lived with the adoptive parent(s) in their legal custody for at least two years;
5. An orphan under the age of 16 when an adoptive or prospective adoptive parent files a visa petition on his or her behalf, who has been adopted abroad by a U.S. citizen or is coming to the U.S. for adoption by a U.S. citizen, or
6. A child adopted who is under the age of 18 and the natural sibling of an orphan or adopted child under the age of 16, if adopted with or after the sibling. The child must also otherwise fit the definition of orphan or adopted child.
1. A children born out of wedlock qualities for immigration benefits based on his or her relationship to his or her natural father if
1) The parent-child relationship is established by clear evidence that a legitimate parent-child relationship exists, as shown by such factors as financial support of the child and cohabitation of the parent and child, or
2) The father had taken the steps required by the law of his place of radiance, or the law of the child’s place of residence, to “legitimate” the child before his or her 18th birthday, and the child had been in the father’s “legal custody” at the time of such “legitimation”;
2. A stepchild qualifies for immigration benefits on the basis on his or her relationship with his or her stepparent(s) as long as the step relationship was formed before the child’s 18th birthday;
3. Adopted children may be considered as children if the adoption occurs prior to the child's 16th birthday, the adoptive parent have legal custody of the child for two years (before or after the adoption)and the child resides with the adoptive parents for two years(before or after the adoption;
